The Website is owned and operated by Amicus India Capital Partners LLP (“Amicus Capital” or the “Firm”). Your visit to the Website is subject to this privacy policy (“Policy”) and our terms of use as available on (“Terms of Use”). By visiting the Website, you agree to this Policy and our Terms of Use, in each case, which we may update at any time and from time to time. Your continued use of the Website after any such amendments/modifications constitutes your acceptance of the amended/modified Policy. In using the Website and sharing your data with us, you acknowledge that you have the capacity to review and enter into a valid contract as per applicable law and you are indicating that you have read, acknowledge and agree to be bound by the Terms. If you do not accept these Terms, then please do not use or access the Website or any pages thereof.
You can use and browse the Website without having to disclose your personal data, except as may be necessary to allow us to respond to your requests.
We collect personal data when you provide it to us through registration, completion of forms, emails, enquiries, requests, and similar situations in which you have chosen to provide the information to us.
The information you provide to us may include your name, address, and email address. If you choose not to provide such information, we may not be able to respond to your request or enquiry.
We will retain control of, and responsibility for, the use of any personal data you disclose to us. Such data will remain in our possession or with service providers acting on our behalf, except in the rare circumstances where we are required under applicable law or by order of any court, tribunal, or regulatory/statutory authority to disclose it to any other person(s).
We process personal data only for lawful purposes, either with your consent or for a "legitimate use" permitted by the DPDP Act.
We will only process your personal data as necessary so that we can pursue the purposes described above. In limited circumstances, where we are required to collect personal data to comply with a legal obligation, we will indicate the same to you prior to collecting such personal data.
We do not sell personal data, and we do not use it for profiling or automated decisions that produce legal effects for you.
Where we rely on consent, we will ask for it through a clear notice that describes the personal data, the purpose and how to withdraw. Your consent is free, specific, informed and limited to the stated purpose. You may give, manage, review or withdraw consent directly with us or, once available, through a consent manager registered with the Data Protection Board of India.
You may withdraw consent at any time by writing to info@amicuscapital.in or through the settings on the investor portal. Withdrawal is as easy as giving consent. It does not affect processing already carried out, or processing we must continue to comply with law, such as KYC record-keeping under the PMLA. If you are an investor, withdrawing consent may mean we cannot continue to administer your investment, and your obligations under the Fund's contribution agreement will continue to apply.
To respond to or process your requests, we may have to disclose your personal data to any member of the Firm or to third parties, such as our service providers and professional advisors, who will process your personal data in accordance with this Policy. Your personal data will not be disclosed to any other parties unless we have obtained your consent or you are legally required to do so under applicable laws.
We take reasonable security safeguards to prevent personal data breaches, including encryption in transit and at rest, multi-factor authentication on the investor portal, role-based access controls, logging and monitoring, regular backups, and confidentiality obligations on staff and processors. We also comply with SEBI's cybersecurity requirements that apply to us. No system is completely secure, so please protect your portal credentials and tell us at once if you suspect misuse.
If a personal data breach occurs, we will notify the Data Protection Board of India and each affected person without delay, as the DPDP Act and Rules require. Our notice to you will describe the breach, its likely consequences, the steps we are taking and what you can do to protect yourself.
The time period for which we retain your personal data depends on the purposes for which we have collected it and is also subject to our obligations under any applicable laws. We retain your personal data for as long as necessary to fulfill those purposes or if a longer retention period is required or permitted by applicable law or any applicable statute of limitations.
As per applicable law, you may exercise the following rights with respect to your personal data:
Access: obtain a summary of the personal data we process about you, the processing activities, and the identities of other data fiduciaries and processors we have shared it with;
Correction and updating: have inaccurate or misleading data corrected, incomplete data completed and data updated;
Erasure: have data erased once it is no longer needed for its purpose, unless the law requires us to keep it; and
Nomination: nominate another person to exercise your rights if you die or become incapable.
We review and verify requests to protect your personal data and will act on data protection requests fairly and in accordance with applicable data protection laws and principles. To exercise the rights listed above, please contact us through the communication channel identified below.
